Terms of Service

Parties

All terms of service are between ARC marketing and any customer choosing to have ARC marketing conduct and Attic Report Card service (referred to as “customer” for the remainder of this contract) and /or complete insulation and air sealing services. The Attic Report Card service is for informational purposes only and no information collected from ARC Marketing will be used in any other fashion than to present the Attic Report Card service or other related service from ARC marketing.

Attic Report Card Appointment

Attic report card appointment are available through the appointment setting calendar at www.atticreportcard.com or by calling ARC Marketing offices. The attic report card is a $99 service that includes a comprehensive 12 point inspection of the attic for energy efficiency purposes. The customer (or someone with the authority to allow the attic report card technician access to the home’s attic space) must be present at the time of the inspection. If nobody is present at the time of the appointment the customer will be responsible for the $99 attic report card fee (even if a promotional code was used). Please see “Appointment Cancelation” below for details on cancelling the appointment.

The inspection will take approx. 15 minutes to ½ hour depending on the size of the attic space. The attic report card will be sent via USPS within 48 hours of the attic report card inspection.

If a promotion code is not used, the $99 attic report card fee must be made to the technician (or via phone payment to the ARC offices) prior to the technician leaving the home on the initial attic report card appointment.

12 Point Inspection

A certified attic report card technician will conduct a 12 point attic inspection at the time of the attic report card appointment. Appointment times will vary but generally can be conducted in 15 to 30 minutes. The technician will conduct a visual inspection of all areas listed below that are reasonably accessible and able to be inspected from the attic space. Inspected areas of the attic include: Current Attic R-Value, Type of Insulation Currently in the Attic, Condition of the Insulation, Ventilation of the Attic Space, Can Light Insulation and Air Sealing, Air Infiltration, Attic Wall Insulation, Duct Work Insulation, Duct Work Condition, Attic Cavities, Radiant Heat Transfer, Animal Infestation.

The nature of this inspection is for energy efficiency grading alone. In no way does the attic report card technician take responsibility for making any safety or functionality judgments or recommendations with regard to any of the inspected items.

Inspection of duct work in the attic (insulation and condition) is a visual inspection only. Technicians will evaluate the condition of all duct work visible in the attic at the time of initial entry into the attic relative to the energy efficiency of the ducts located in the attic.

Inspection for animal infestation is a visual inspection of any clear evidence of animal presence. Many instances of animal presence in the attic are not readily visible and may not be included as part of the attic report card report.

Attic Space

The attic space may be considered a non-living space above a living space. Attic spaces applicable to the attic report card must be reasonably accessible for a full size adult to enter and navigate in a safe manner. If a technician is not able to reasonably and safely navigate the entire attic space, a report card may be generated by conducting an inspection from the area of the attic that is reasonably and safely accessible. Areas in the attic space not reasonably and safely accessible may be evaluated by a sight inspection from the attic space area that is reasonably and safely accessible or a reasonable assumption of condition can be made based on other areas of the attic.

Promotional Codes

Promotional codes may be made available from time to time granting a discount for the $99 attic report card service. Promotional codes may be limited in duration. Any promotional code without a stated expiration date will be deemed good for 90 days from the date received. Promotional codes will not be accepted as means of paying the $99 service charge for missed appointments. If a promotional code was used to set up an attic report card appointment and the customer (or authorized person) was not present to allow the attic report card technician access to the attic, the promotion code cannot be used to pay for the missed appointment fee (see appointment cancelation for details).

Promotional codes can be redeemed by visiting www.atticreportcard.com and clicking “GRADE MY ATTIC” by calling 816-866-0650 or 1-855 GRADE IT (1-855-472-3348).

The Initial Attic Report Card

The initial attic report card is the attic report card presented as a result of the attic report card technician inspecting the customer’s attic.

The attic report is a mailed document that will be mailed to the customer via USPS within 2 business days of the attic report card appointment. This document will present and overall grade for the attic relative to energy efficiency and give the attic a rating on a scale of 1 – 100 relative to energy efficiency. Grades given are a subjective grade based on the insulation building code minimum standards, the Energy Star insulation standards, and best industry knowledge of proper residential attic insulation. A+ (100 rating) grades are given to areas of the attic that meet the highest of these standards in terms of energy efficiency, F- (0 rating) is given to areas of the attic that are at the lowest standard. All grades in between are rated relative to these two grading levels. Each attic area is weighted to reflect appropriately in the attics overall grade. Graded areas of the attic include: Current Attic R-Value, Type of Insulation Currently in the Attic, Condition of the Insulation, Ventilation of the Attic Space, Can Light Insulation and Air Sealing, Air Infiltration, Attic Wall Insulation, Duct Work Insulation, Duct Work Condition, Attic Cavities, Radiant Heat Transfer, Animal Infestation.

The Final Attic Report Card

The final attic report card is the report card presented to customers after they have hired ARC Marketing to improve their attic insulation grade by choosing one of the presented attic insulation services.

The final attic report card will be an updated report card reflecting the attics grade after the improvements have been made (if Attic Report Card is hired to make insulation improvement). This document will be useful to home owners as a part of their home’s resale package.

The final attic report is a mailed document that will be mailed to the customer via USPS within 1 week business days of the insulation services being completed.

Appointment Cancellation

If a customer needs to cancel an attic report card appointment the customer must contact our offices at (816) 866-0650 or 1-855 GRADE IT (1-855-472-3348) at least 2 hours prior to the appointment. We will be happy to reschedule the customer’s appointment with no additional charge. If a customer used a promo code for the appointment, the customer may use this promotional code again for the rescheduled appointment.

If the customer does not call to cancel an appointment and there is no one at the home to let the attic report card technician into the attic for the inspection, the customer can be charged $99 for a missed appointment. Even if the customer has used a promo code to get the attic report card for free, the customer can still be charged $99 for the missed appointment if the technician comes to your home and nobody is there to give them access to the attic for the inspection.

Any court costs involved in the process of collecting for work done will be paid by the customer. ARC Marketing also reserves the right to come remove insulation service completed if payment is not made in full in a timely manner. Any cost involved in the removal of the insulation is to be paid by the customer.

If for any reason you are not satisfied that the work was not complete to industry standards and in accordance to the proposed work, ARC Marketing will bring the completed work up to industry standard and / or in accordance with the proposed work.

Energy Savings Guarantee

Each Attic Report Card includes 3 levels of proposed services. Each proposed service includes a “payback guarantee”. In order to qualify for the payback guarantee, the customer must provide ARC Marketing with copies of all relevant utility bills for the time period of 1 year (each bill for the last 12 months) prior to the service date. Relevant utility bills included utilities that are powering the primary method of heating and cooling the customer’s home. These bills must be delivered to ARC Marketing within 30 days of service being completed. Copies of utility bills can be sent to 9290 Bond #101 Overland Park, Kansas, 66214. Customers will also be required to complete a usage survey to qualify for the guarantee. The usage survey will be sent to the customer upon the receipt of the relevant utility bills. The email address used to deliver the Attic Report Card will be the same email address used to send the survey. If no email address is provided, a survey will be sent via US postal service to the home’s address where the Attic Report Card was conducted.

Customers must save all relevant utility bills for the guarantee period and present the bills the ARC Marketing in the case of a dispute in guaranteed savings. ARC marketing will measure the average energy usage for the 12 months of energy bills provided prior to the service (base year). This average energy use will be measured against the average energy usage for the payback period (payback years). This usage difference between the base year and payback years will be used to calculate actual savings. The total energy unit savings for the payback period will be taken times (x) the cost of a single unit of energy unit to calculate the total dollar savings. The cost of the energy unit used to determine total dollar value of energy saved will be determined by taking the higher of the energy unit cost between the date of service and the last month of the payback period.

When calculating the payback guarantee ARC marketing has the right to factor our years in which the average temperature during the extreme heating and cooling season (January – March, June – September, November-December) are outside seasonal norms (within 5% of average annual temperate). In this case, the average of all of the other years energy usage (with normal temperature ranges) will be used to calculate energy savings for year outside the seasonal norms. Calculating seasonal norms will be only relevant to unseasonable cool temperatures in the summer and unseasonably warm temperatures in the winter.

Customers will be required to complete a usage survey at the end of the payback period in the case of disputed guaranteed savings. ARC Marketing reserves the right to adjust the energy savings payback period if the customer’s general usage has significantly changed. Factors such as family size, new household equipment, residential additions, newly finished living spaces, and any other factor that have significantly change energy usage requirements may change or void any payback guarantee.

ARC Marketing guarantees that “all things staying the same” you will save money (according to our energy savings guarantee) or we will pay the difference. If there are significant changes to how much energy you use, we cannot guarantee any savings.

Upon completion on the payback period and review of the utility bills and usage survey, ARC Marketing agrees to pay the difference between the sales amount and the actual savings to the customer within 90 days of the utility bills and usage being approved.

All parties agree to resolve any disputes in this matter by going before a certified arbitrator in these matters.
